The ‘Piece of Mind’ Agreement  (ALSO KNOWN AS “POM” or ‘Liability Damage Waiver’):

NOTICE: THIS CONTRACT OFFERS, FOR AN ADDITIONAL CHARGE, A LIABILITY DAMAGE WAIVER TO COVER YOUR RESPONSIBILITY FOR DAMAGE TO THE PROPERTY. BEFORE DECIDING WHETHER TO PURCHASE THE LIABILITY DAMAGE WAIVER ( “POM”). YOU MAY WISH TO DETERMINE WHETHER YOUR OWN HOMEOWNERS OR CASUALTY INSURANCE AFFORDS YOU COVERAGE FOR DAMAGE TO THE RENTAL PROPERTY, AND THE AMOUNT OF THE DEDUCTIBLE UNDER YOUR OWN INSURANCE COVERAGE.

Enrollment in the Peace of Mind Agreement (POM) is optional but recommended.  You may elect to enroll in the Peace of Mind Agreement (POM)  

"POM" TERMS:

INSTRUMENT DAMAGE AND REPAIR:

The Peace of Mind Agreement (POM)  covers many repairs at no charge to you.  The Peace of Mind Agreement (POM)   does not include damage to finishes, cosmetic damage to cases, case feet, string breakage (after the first 30 days of rentals), reeds, drum sticks and mallets, drums heads, bow hair, rosin, brass and woodwind mouthpiece loss, neck straps, ligature and mouthpiece cap loss, swabs or cloths to the extent any of the foregoing is caused by moisture, scratches, mysterious disappearance, vandalism, abandonment of the property, or any other damage intentionally caused by  the lessee or that results from the lessee's willful or wanton misconduct. No reimbursement will be made for repairs made to covered instruments made by you or preformed other parties on your authorization. Contact our Customer Service for instructions for service/replacement of your covered instrument.

INSTRUMENT LOSS AND CLAIM:

Enrolling in the Peace of Mind Agreement (POM)   by paying the Peace of Mind Agreement (POM)   protects you for loss of or damage to the instrument due to fire or theft- to quality for coverage, you must provide us with a police report showing a record of theft at the address where the instrument was permitted to be located under this Agreement within 4 days of the loss.  The Peace of Mind Agreement (POM)   does not cover  moisture, scratches, vandalism, abandonment of the property, or  mysterious disappearance not by documented theft .  We reserve the right to determine within our reasonable discretion what is a “mysterious disappearance” and to require a police report or other evidence of theft.  The Peace of Mind Agreement (POM)   does not cover any damage intentionally caused by you or that results from your willful or wanton misconduct.

If you claim a loss of the instrument under the Peace of Mind Agreement (POM) , payments made prior to the date of loss are not refundable or transferable.  If you claim a loss under the Peace of Mind Agreement (POM)  , you agree that we are subrogated to all of your rights, claims, and remedies due to the loss of the instrument, including, but in no way limited to, your rights or any recoveries under any insurance policies.

OPTIONAL INSURANCE: The purchase of insurance is not required as a condition of your rental of the instrument under the Rental Agreement. If you elect to buy insurance for the instrument, you may buy the insurance through any insurer you may choose.
